India has passed patent Act on 1972. In India there are no awareness
about this patent law and it’s benefits but American & European Countries
Got patent for their Medicinal herbs. Likewise any Country can got Patent for
their Scientific Inventions, Books, New Inventions & also for Ancient Products,
Dishes etc… Example Madurai Malli [Jasmine], Tirunelveli Halwa, Erode Manjal
[Turmeric], Kanchipuram Pattu [Silk], Mysore Silk, Kashmir Saffron etc…
On July
31, 1790 Samuel Hopkins was issued the First Patent for a process of making
Potash, an Ingredient used in Fertilizer.The Patent was signed by President
George Washington. Few Number of Patents granted by U.S IBM-9,262, Samsung
Electronics Co.Ltd-6,469, Canon KK-3,548, Microsoft Technology Licensing LLC-3,081.
In 2017,
India’s Patent Office granted 12,387 Patents on 2016 it was 8,248. In India for
First 20 Years ownership is for Applicant who got Patent. After 4 to 6 Years
from Filling Patent will Grant by Indian Government. For an Idea, the cost to
file a Patent is Approximately Rs 45,000 to 65,000. This is assuming that you
have hired a Patent (patent) professionals for patent research, writing and
filing patent application for your Invention.
Once Anglo Americans who were migrated from India got patent for
Turmeric at U.S.A but, Indian Industries Department & Medical Corporation filed
the Evidence to America then America withdraw their patent ship on Turmeric.
After this once European Company gave Patent Rights to produce Fungicide
from Neem Seeds for Fertilizer Company in U.S.A
on that time India Submitted Evidence
& Got its Great Success on that Patent.
America Got Patent on “ Aroma Basmati” but it is as like as Indian Basmati in type 16 So India filed Case on that but Indian Government did not submitted proper Evidence so on this Patent Indian Government failed to got Patent on Basmati Rice. Now Indian Farmers faces a lot difficulties Export Basmati Rice. Now in India 85% of things had Patent by various Companies.You can also get Patent for your Dishes & New Inventions.
